When purchased in the U.S. or Canada from NightCare directly from NightCare, including this website or from an authorized NightCare Dealer, a NightCare pillow or topper will be replaced or refunded at NightCare's option if it fails to stand up to normal wear-and-tear for 2 YEARS as a result of defects due to materials or workmanship. NightCare Mattresses -- 15-year Limited Warranty
When purchased in the U.S. or Canada directly from NightCare, including this website or from an authorized NightCare Dealer, NightCare will replace, or repair at NightCare's option, any defective product or component with a proration of cost to the original user /purchaser based on the following proration-based table. The "cost" to the warranty holder is a prorated portion of the NightCare replacement price of the defective product or component at the time the warranty claim is made, or if the original product or component is no longer in production, it will be a prorated portion of the NightCare price of a comparable product model or component. This prorated cost is determined by the time from the date of the original purchase to the date that purchaser's valid warranty claim is submitted.

For example, if a warranty claim occurs 10 years after the original purchase date, the cost to the original purchaser would be 70% of the NightCare replacement price (the calculation being 10% plus 6% for each of the 10 years = 70%. In this example, NightCare would be absorbing 30% of the current replacement price.
It is understood that defects in materials and workmanship do not include the effects of normal wear and tear on the mattress or its cover, and that the limited warranty does not include a normal increase in softness of the NightCare pressure-alleviating material which do not affect the pressure-relieving qualities of the mattress. A visible indentation, if any, of the mattress core less than three-fourths (0.75) of an inch, is not covered by warranty.

In addition to the above, the following General Warranty Terms and Conditions are also applicable to all NightCare products:
Warranty is Non-transferrable: Product warranties are valid for the original retail purchaser and are non-transferrable. A sale, transfer or other disposal of the warranted product or component voids the warranty.
Securing a Return Merchandise Authorization: Just email or call our NightCare Customer Service stating the reason of the return plus your contact and mailing information. Request and receive a Return Merchandise Authorization (RMA).
Product Return and Shipping: Return the product with your proof of purchase and original sales receipt to Allied Aerofoam, LLC, Consumer Products division, 5000 Westpark Drive, Atlanta, GA 30336, and reference the RMA number on the packaging and all correspondence.
General Exclusions: If a product is returned without a pre-authorized RMA number or if the returned product defect, upon its inspection, is not covered by the warranty, the shipping costs to the factory or the Warranty Return Center are the responsibility of the purchaser.
The warranty does not cover conditions arising from normal wear and tear. Conditions arising from normal wear and tear include, but are not limited to, foam compression, mattress foam compression, or discoloration of components. The warranty does not cover physical damage, cuts, burns, tears, punctures, scratches or abbraisions, misuse, abuse, stains, damage from washing, laundering or cleaning, any chemicals applied, soiled or unsanitary conditions, and/or acts of God.
Other Warranties, and/or Not purchased directly from NightCare: Some authorized manufacturers have licensed the NightCare's patented technology and are marketing their own branded products under license with NightCare's technology inside. If your NightCare-based product was not purchased directly from NightCare or a NightCare Authorized Dealer, but was instead purchased from a retail dealer, a big box store, website or retail establishment which is not owned by NightCare and/or is not one of its Authorized Dealers, then your product may have a different manufacturers warranty and terms provided by its licensed manufacturer and/or your product's retailer. In such case, your warranty will be honored by the Customer Service Department of the retailer where you made the purchase, and/or in accordance with the printed warranty included with your purchase. If you have any questions in this regard, please contact us. The warranty literature you received with your product also provides the specific warranty information.
Right of Substitution: NightCare reserves the right to substitute products or components of equal or better quality, and to use or deliver refurbished products or components, in the replacement or repair of any product under this limited warranty.
Limitations:
- NightCare reserves the right to refuse to repair or replace any product or component that is returned in an unsanitary condition.
- This Limited Warranty applies only to the product as used in the United States and Canada. It is not applicalbe in U.S. territories or other countries.
- This Limited Warranty is non-transferrable.
- Repair or replacement off a product or component under the terms of the Limited Warranty in no way lengthens the limited warranty period.
- ANY IMPLIED WARRANTIES APPLICABLE TO THE PRODUCT, INCLUDING ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE DURATION AND OTHER TERMS OF THE WRITTEN LIMITED WARRANTY.
- Customer maintains responsibility for installation of parts replaced under terms of the warranty.
- Your exclusive remedy, IN LIEU OF ALL INCIDENTAL, SPECIAL or CONSEQUENTIAL DAMAGES, INCLUDING FOR NEGLIGENCE, is limited to repair or replacement of any product or component deemed to be defective under the terms and conditions stated above.
- Your exclusive remedy, IN LIEU OF ALL INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING FOR NEGLIGENCE, is limited to repair or replacement of any product or component deemed to be defective under the terms and conditions stated above. NightCare will bear no other damages or expenses.
Note: Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on how long an implied warranty lasts, so the above limitations may not apply to you. This warranty gives you specific legal rights, and you may also have other rights, which vary from state to state.
